These Terms & Conditions (“Terms”) govern your access to and use of ShareToPaint, available at sharetopaint.com (the “Service”), operated by Nagy Gergely Máté (“we”, “us”, “our”). By accessing the Service, drawing on the canvas, referring others, or making a payment, you agree to be bound by these Terms. If you do not agree, do not use the Service.
ShareToPaint is a single shared 1000×1000 pixel canvas. You may draw freeform pixel artwork (a “drawing”) and then complete it in one of two ways:
The Service is provided on an “as is” and “as available” basis. We may change, add, suspend, or remove features, and may modify the canvas mechanics (for example fill rates, pricing, or expiry rules) at any time.
You must be at least 13 years old to use the Service. If you are under 18, you may use the Service only with the involvement and consent of a parent or legal guardian, and only that adult may make purchases. By using the Service you represent that you meet these requirements and that any information you provide is accurate.
The Service does not require you to create an account or password. You are identified by an anonymous token stored in your browser (a cookie and local storage). You are responsible for activity that occurs through your browser and token. Clearing your browser storage may cause you to lose access to drawings and referral credit associated with that token.
You are solely responsible for the pixels you draw and any link you attach to paid artwork. By drawing on the canvas, you grant us a worldwide, royalty-free, perpetual, irrevocable license to host, store, reproduce, and publicly display that content as part of the shared canvas, including in snapshots, previews, and promotional material for the Service.
You agree not to use the Service to create, upload, or link to content that:
We are not obligated to monitor content, but we may, at our sole discretion and without notice, remove, overwrite, or refuse any content or link — and suspend access — where we believe it is unlawful or that we are legally required to do so. Because the canvas is a single shared surface, artwork you create is visible to all other users.
Free (recruit) drawings are not guaranteed to be permanent. A free drawing that has not been completed may expire, decay, be released, and have its reserved space made available to others in accordance with the Service’s then-current rules, including if it attracts no qualifying referrals within the applicable time window or is not completed before its deadline. Released pixels may be drawn over by other users.
Paid drawings and completed drawings are treated as permanent and are not subject to the expiry or overwrite rules above — provided the Service continues to operate (see Section 9). We do not guarantee that any drawing will remain on the canvas indefinitely if the Service is discontinued.
Placement on the canvas is subject to availability and to our placement rules, which may prevent a drawing from overlapping certain existing artwork. We may re-shape, reduce, or release a drawing where required by these rules.
You may share a personal referral link. When a person you refer meets the qualification conditions applied by the Service, a fixed number of pixels of your active free drawing are filled. Referral credit:
We may change the number of pixels awarded per referral, the qualification rules, and the program itself at any time, and may terminate the program without liability to you.
Paid pixels are priced at US$1.00 per pixel, subject to a minimum purchase of 20 pixels (US$20.00). Prices are shown before you confirm a purchase. Payments are processed by our third-party payment provider, Stripe; we do not receive or store your full card details. Your purchase is also subject to Stripe’s terms.
Purchased pixels are a digital good that is delivered and filled onto the canvas immediately upon successful payment. You are responsible for any taxes that apply to your purchase unless we state otherwise. We may change prices prospectively; changes do not affect purchases already completed.
Because purchased pixels are digital goods delivered instantly and permanently, all sales are final and non-refundable once your pixels have been placed, except as required by law. If we are unable to deliver your purchased pixels — for example because the underlying drawing was released, completed, or displaced before your payment settled — we will automatically refund the affected payment to your original payment method.
EU consumers — right of withdrawal. Purchased pixels are digital content supplied on a non-tangible medium. By completing a purchase, you expressly request that we begin performance (delivering and placing your pixels) immediately, and you acknowledge that once delivery has begun you lose your statutory right of withdrawal (the 14-day cooling-off period) for that purchase, in accordance with the Hungarian rules implementing Directive 2011/83/EU on consumer rights.
You may attach a single web link (URL) to paid artwork, which other users can open by interacting with your pixels. You are solely responsible for the destination and its content. We may remove or disable any link that points to unlawful, harmful, deceptive, or malicious material, or that we are otherwise required to remove. A link does not imply our endorsement of its destination.
We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that any drawing will be preserved. We may suspend, limit, or discontinue the Service, in whole or in part, at any time. References to pixels being “permanent” describe their treatment on the canvas while the Service operates and do not constitute a guarantee that the Service, or any drawing, will exist for any particular period.
The Service, including its software, design, and branding, is owned by Nagy Gergely Máté and protected by intellectual-property laws. You retain any rights you hold in original artwork you create, subject to the license you grant in Section 4. You may not copy, modify, reverse engineer, scrape, or create derivative works of the Service except as permitted by law.
To the maximum extent permitted by law, the Service is provided “as is” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the canvas, any drawing, or any referral credit will meet your expectations or remain available.
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, drawings, referral credit, profits, or goodwill, arising out of or related to your use of the Service. Our total aggregate liability for all claims relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim, or US$100. Nothing in these Terms limits liability that cannot be limited under applicable law.
You agree to indemnify and hold harmless Nagy Gergely Máté from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your content, your links, your use of the Service, or your breach of these Terms.
We may suspend or terminate your access to the Service at any time if you breach these Terms or if we reasonably believe your use is unlawful or harmful to the Service or other users. Sections that by their nature should survive termination (including Sections 4, and 11 through 16) will survive.
These Terms are governed by the laws of Hungary, without regard to conflict-of-law rules. The courts of Hungary will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, except where mandatory consumer law entitles you to bring proceedings elsewhere.
We may update these Terms from time to time. The “Last updated” date above reflects the latest version. Material changes take effect when posted; your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
