These Terms & Conditions (“Terms”) govern your use of ShareToPaint at sharetopaint.com (the “Service”), operated by Nagy Gergely Máté (“we”, “us”, “our”). By using the Service, painting on the canvas, inviting others, creating an account or making a payment, you agree to these Terms. If you do not agree, do not use the Service.
ShareToPaint is a single shared canvas of 1000×1000 pixels that anyone can paint on. Painting uses ink. Ink refills on its own over time for free. You can also earn it by inviting friends, or buy it in packs.
Anything you paint with ink can be painted over by other people. If you want to keep a piece, you can buy the pixels it covers (Section 6). Nobody else can paint on pixels you own.
The Service is provided “as is” and “as available”. We may change, add, pause or remove features at any time, including how fast ink refills, what painting costs, and the prices we charge.
You must be at least 13 years old to use the Service. If you are under 18, you may use it only with the involvement and consent of a parent or legal guardian, and only that adult may make purchases. By using the Service you confirm that you meet these requirements and that the information you give us is accurate.
You can paint without an account. In that case you are identified by a random token stored in your browser (a cookie with a backup in local storage). Your ink and your artwork belong to that token. If you clear your browser data, that token is gone, and we cannot restore it or move its ink and pixels to another one.
You can also create a free account with just your email address. There is no password: we email you a one-time link, and opening it signs you in. Creating an account attaches it to the token your browser already has, so nothing you painted or earned is lost. An account starts working once you open the confirmation link. With an account you can sign in on other devices (enter the same email address and we send a sign-in link), and your refilling ink goes up to a higher limit and refills faster.
You need a confirmed account to buy anything. This makes sure every purchase stays linked to you even if you clear your browser.
Anyone who can open your email can sign in to your account, so keep your email account secure. You are responsible for what happens through your account and your browser. If you think someone else has access to your account, email us and we will sign every device out. You can ask us to delete your account at any time by emailing us (see the Privacy Policy for what happens to your data).
You are responsible for the pixels you paint and any link you add. By painting on the canvas, you give us a worldwide, royalty-free, perpetual and irrevocable licence to host, store, copy and publicly display that content as part of the shared canvas, including in snapshots, previews and promotional material for the Service.

We do not have to monitor content, but we may act on content or behaviour that breaks these Terms, as described in Section 11.
Every pixel you paint uses ink. Your ink has two parts:
Painting uses your refilling ink first. Painting over someone else’s pixels costs more ink than painting on empty canvas, and pixels that were just painted are protected from other people for a few minutes. Repainting pixels you own is free. The Service shows the current costs, and we may change them.
Ink is not money. It has no cash value and cannot be exchanged, transferred, sold or cashed out. You can only use it to paint.
Paint you do not own is not permanent. Other people can paint over it at any time. We do not give back ink for pixels that get painted over.
You can buy the pixels of a piece you painted. When you pick a piece, we work out the area you would own: your connected painted pixels, plus any empty pixels your art completely surrounds. We show you that area on the canvas and its price before you pay. An area has a minimum size, and a purchase has a minimum charge.
The price per pixel is shown before you pay. It goes up as more of the canvas becomes owned, so the price you see applies to that purchase only. We hold the price for a limited time while you pay.
The canvas is not frozen while you pay. If someone paints over your piece during checkout and your payment completes, the area is restored to how it looked when you picked it. If you do not complete the payment, the held price expires.
Once you own an area, nobody else can paint on it, and you can repaint inside it for free. Ownership cannot be transferred or sold. It lasts for as long as the Service runs, subject to Sections 10 and 11.
You can add one web link to an area you own. People who click those pixels on the canvas go to that address. A link is rented, not bought. The first year starts when you add the link (or when you buy the area with a link). After that, the link stays active only if you renew it at the current yearly fee. If you do not renew, the link stops working, but your pixels stay yours and nothing about the art changes. Renewing brings the same link back.
You are responsible for where your link goes. We may remove any link that points to unlawful, harmful, misleading or malicious content, or that we are required to remove, without refunding the fee and without affecting your pixels. Once we have removed a link, you cannot add it back yourself. Links are marked nofollow and do not mean we endorse the site they point to.
You have a personal invite link. When someone arrives through it and meets the conditions the Service shows (currently, painting a small number of pixels of their own and staying on the canvas for a short time), you get bonus ink. You get more bonus ink if that person then confirms an account. An invite only counts for the first link a visitor arrives through, within a limited time.

Payments are processed by Stripe. We never receive or store your full card details, and your payment is also subject to Stripe’s terms. The receipt goes to your account email address. You are responsible for any taxes that apply, unless we say otherwise. Price changes apply to future purchases only.
Ink is added to your balance, ownership is applied to the canvas, and link time is added as soon as your payment goes through. Because these digital goods are delivered immediately, sales are final once delivered, except where the law says otherwise or as set out below.
If we cannot deliver. If we cannot deliver what you paid for, for example because the area you were buying was no longer available when the payment arrived, we refund the payment to your original payment method automatically.

EU consumers. Ink, owned pixels and link renewals are digital content supplied without a physical medium. When you complete a purchase, you ask us to deliver it straight away, and you agree that you lose your 14-day right of withdrawal for that purchase once delivery has started, in line with the Hungarian rules implementing Directive 2011/83/EU on consumer rights.
To keep the canvas usable and lawful, we may, at our discretion and without notice:
Erased paint cannot be brought back: the Service keeps only the current state of each pixel. Where we restrict or end your access because you broke these Terms, we do not refund unused ink, ownership or link time, except where the law requires it.
We do not promise that the Service will be uninterrupted, secure or free of errors, or that any artwork will be kept. We may pause, limit or shut down the Service, in whole or in part, at any time. When we say owned pixels are “permanent”, we mean how they behave on the canvas while the Service runs, not that the Service or any artwork will exist for a particular length of time. Unused ink does not give you a right to a refund if the Service closes, except where the law requires it.
The Service, including its software, design and branding, belongs to Nagy Gergely Máté and is protected by intellectual property laws. You keep any rights you have in original artwork you create, subject to the licence in Section 4. You may not copy, modify, reverse engineer, scrape or build derivative works of the Service, except where the law allows it.
To the fullest extent the law allows, the Service is provided “as is”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the canvas, any artwork or any ink balance will meet your expectations or stay available.
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for any loss of data, artwork, ink, profits or goodwill, arising from your use of the Service. Our total liability for all claims about the Service is limited to the greater of what you paid us in the 12 months before the claim and US$100. Nothing in these Terms limits liability that cannot be limited by law.
You agree to compensate Nagy Gergely Máté for claims, damages, liabilities and costs (including reasonable legal fees) that arise from your content, your links, your use of the Service or your breach of these Terms.
We may suspend or end your access to the Service at any time if you break these Terms or if we reasonably believe your use is unlawful or harmful to the Service or other users. Sections 4, 11 and 13 to 18 continue to apply after that.
These Terms are governed by the laws of Hungary, without regard to its conflict of law rules. The courts of Hungary have exclusive jurisdiction over any dispute about these Terms or the Service, except where consumer law lets you bring a claim elsewhere.
We may update these Terms. The “Last updated” date above shows the current version. Changes take effect when they are published, and if you keep using the Service after that, you accept the updated Terms.
