Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of ShareToPaint, available at sharetopaint.com (the “Service”), operated by Nagy Gergely Máté (“we”, “us”, “our”). By accessing the Service, drawing on the canvas, referring others, or making a payment, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

ShareToPaint is a single shared 1000×1000 pixel canvas that anyone may paint on. Painting costs ink. Ink refills on its own over time at no charge, and can also be earned by referring others or bought in packs. Anything you paint with ink is not permanent — other users may paint over it.

Permanence is a separate, paid step. You may seal a region of your own artwork, which creates a deed over it: nobody else can paint on a deeded region, and only you may repaint inside it. The share of the canvas that may ever be deeded is capped.

The Service is provided on an “as is” and “as available” basis. We may change, add, suspend, or remove features, and may modify the canvas mechanics (for example ink rates, ink costs, prices, or the deed cap) at any time.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you may use the Service only with the involvement and consent of a parent or legal guardian, and only that adult may make purchases. By using the Service you represent that you meet these requirements and that any information you provide is accurate.

3. Your identity

The Service does not require you to create an account or password. You are identified by an anonymous token stored in your browser (a cookie and local storage). You are responsible for activity that occurs through your browser and token. Clearing your browser storage may cause you to permanently lose access to your ink balance, your deeds, and any referral credit associated with that token. We have no way to restore a lost token or to transfer a balance between tokens.

4. Your content and conduct

You are solely responsible for the pixels you paint and any link you attach to a deed. By painting on the canvas, you grant us a worldwide, royalty-free, perpetual, irrevocable license to host, store, reproduce, and publicly display that content as part of the shared canvas, including in snapshots, previews, and promotional material for the Service.

You agree not to use the Service to create, upload, or link to content that:

  • is unlawful, or infringes the intellectual-property or other rights of any person;
  • depicts child sexual abuse material, or is otherwise illegal to display in your or our jurisdiction;
  • is intended to defraud, deceive, or distribute malware; or
  • you do not have the right to submit.

We are not obligated to monitor content, but we may, at our sole discretion and without notice, remove, overwrite, or refuse any content or link — and suspend access — where we believe it is unlawful or that we are legally required to do so. This includes revoking a deed and erasing the artwork it protects, even though deeds are otherwise permanent, where the content is unlawful or we are required to remove it. Because the canvas is a single shared surface, artwork you create is visible to all other users.

5. Ink and painting

Each pixel you paint costs ink. Ink is held in two balances:

  • Refilling ink, which regenerates automatically up to a maximum and then stops; and
  • Banked ink, from referrals and purchases, which has no maximum and does not expire.

Spending draws from your refilling balance first. Painting over another user’s unsealed pixels costs a multiple of the normal price, and pixels painted recently are protected from being painted over by others for a short period. These rates are set by us and may change.

Ink is not money. It has no cash value, is not a stored-value or payment instrument, and cannot be exchanged, transferred, resold, or redeemed for cash. It can only be used to paint on the canvas.

Unsealed pixels are not permanent. Anything you paint that is not covered by a deed may be painted over by any other user at any time. Ink spent on pixels that are later painted over is not refunded or restored. If you want your artwork protected, you must seal it.

6. Sealing and deeds

Sealing is a purchase that makes a region of your artwork permanent. When you request a quote, we calculate the region — the connected area of your own pixels together with any area they enclose — and lock a price and a reservation for a limited time. The price per unit of area rises as more of the canvas becomes deeded, so the price you are shown at quote is the price you pay for that quote only.

A deed means that, while the Service operates, no other user may paint on that region and you may repaint inside it at no ink cost. Deeds are not transferable or resellable. There is a minimum sealable area and a cap on the total share of the canvas that may ever be deeded; once that cap is reached, no further deeds are available.

The canvas is not frozen while you are paying. Others may paint over your artwork during checkout; if your payment completes, the region is restored to the state captured in your quote. If you do not complete payment, the quote expires and its reservation is released.

7. Referral program

You may share a personal referral link. When a person you refer meets the qualification conditions applied by the Service — which currently include spending some ink of their own and remaining on the canvas for a minimum period — we grant you a fixed amount of banked ink. Referral credit:

  • is granted in ink only, and never in deeds, permanence, or money;
  • has no cash value and cannot be exchanged, transferred, or redeemed for money;
  • is granted only when our qualification and anti-fraud checks are satisfied, as determined by us; and
  • may be withheld, reversed, or disqualified where we detect self-referral, collusion, automated activity, or other abuse.

We may change the amount of ink awarded per referral, the qualification rules, and the program itself at any time, and may terminate the program without liability to you.

8. Payments and pricing

We sell three things:

  • Ink packs — a fixed quantity of banked ink at the price shown before you confirm;
  • Seals — a deed over a region of your artwork, priced by area at the rate quoted to you; and
  • Link renewals — a periodic fee to keep a link attached to a deed (Section 10).

Prices are shown before you confirm a purchase. Payments are processed by our third-party payment provider, Stripe; we do not receive or store your full card details. Your purchase is also subject to Stripe’s terms. You are responsible for any taxes that apply to your purchase unless we state otherwise. We may change prices prospectively; changes do not affect purchases already completed.

9. Refunds, reversals, and right of withdrawal

Ink is credited to your balance immediately on payment, and deeds are applied to the canvas immediately on payment. Because these are digital goods delivered instantly, all sales are final and non-refundable once delivered, except as required by law or as set out below.

Where we cannot deliver. If we are unable to deliver what you paid for — for example because the region you were buying was no longer available when your payment settled — we will automatically refund that payment to your original payment method.

Chargebacks and reversals. If you reverse, dispute, or charge back a payment, we may withdraw what that payment bought. For an ink purchase, your entire banked ink balance may be cleared; ink you have already spent cannot be recovered, because the pixels it painted are already on the shared canvas and may already have been painted over by others. For a seal, the deed may be revoked, which ends its permanence. For a link renewal, the link may be disabled. Your refilling ink is not affected. We may also suspend access under Section 16.

EU consumers — right of withdrawal. Ink, deeds, and link renewals are digital content supplied on a non-tangible medium. By completing a purchase, you expressly request that we begin performance (crediting your ink, applying your deed, or extending your link) immediately, and you acknowledge that once delivery has begun you lose your statutory right of withdrawal (the 14-day cooling-off period) for that purchase, in accordance with the Hungarian rules implementing Directive 2011/83/EU on consumer rights.

10. Links on deeded artwork

You may attach a single web link (URL) to a deed, which other users can open by interacting with your pixels. A link is a rental, not a purchase. It runs for a fixed period and must be renewed at the then-current fee to stay active. When a link lapses it simply stops working — your deed and the artwork it protects are entirely unaffected, and renewing reactivates the same link.

You are solely responsible for the destination and its content. We may remove or disable any link that points to unlawful, harmful, deceptive, or malicious material, or that we are otherwise required to remove, without refunding the rental fee and without affecting your deed or artwork. Links are published with a nofollow attribute and do not confer search-engine endorsement. A link does not imply our endorsement of its destination.

11. Availability and changes to the Service

We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that any artwork will be preserved. We may suspend, limit, or discontinue the Service, in whole or in part, at any time. References to a deed being “permanent” describe its treatment on the canvas while the Service operates and do not constitute a guarantee that the Service, or any artwork, will exist for any particular period. Unspent ink confers no right to a refund if the Service is discontinued, except as required by law.

12. Intellectual property

The Service, including its software, design, and branding, is owned by Nagy Gergely Máté and protected by intellectual-property laws. You retain any rights you hold in original artwork you create, subject to the license you grant in Section 4. You may not copy, modify, reverse engineer, scrape, or create derivative works of the Service except as permitted by law.

13. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the canvas, any drawing, or any ink balance will meet your expectations or remain available.

14. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, artwork, ink, profits, or goodwill, arising out of or related to your use of the Service. Our total aggregate liability for all claims relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim, or US$100. Nothing in these Terms limits liability that cannot be limited under applicable law.

15. Indemnification

You agree to indemnify and hold harmless Nagy Gergely Máté from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your content, your links, your use of the Service, or your breach of these Terms.

16. Suspension and termination

We may suspend or terminate your access to the Service at any time if you breach these Terms or if we reasonably believe your use is unlawful or harmful to the Service or other users. Sections that by their nature should survive termination (including Sections 4, and 12 through 17) will survive.

17. Governing law and disputes

These Terms are governed by the laws of Hungary, without regard to conflict-of-law rules. The courts of Hungary will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, except where mandatory consumer law entitles you to bring proceedings elsewhere.

18. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date above reflects the latest version. Material changes take effect when posted; your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
